By accessing or using Highlight ("we," "us," or "our") services, including our application, website, and bot functionality, you ("you" or "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

Highlight is an AI-powered social media tool that allows users to:

  • Save social media posts by commenting with @mentioning our bot or sharing posts via direct message
  • Ask questions, get ratings, fact-checks, and commentary on content through @mentions
  • Organize and search saved content
  • Generate smart actions based on saved content (such as shopping lists from recipes)
  • Chat with AI about saved content within our application

3. User Accounts and Registration

3.1 Account Creation

  • To save posts and access full features, you must create an account and provide a valid email address
  • Currently, account creation requires linking your Google Gmail account
  • You are responsible for maintaining the security of your account credentials

3.2 Public Interactions

  • @mentioning our bot in social media comments does not require account creation
  • These public interactions are logged and may be used to improve our services

4. Permitted Use and Restrictions

4.1 Permitted Use

You may use Highlight for personal, non-commercial purposes to save, organize, and interact with social media content.

4.2 Prohibited Conduct

You may not:

  • Use the service for illegal activities or to violate others' rights
  • Attempt to circumvent usage limits or security measures
  • Spam, harass, or abuse other users or our service
  • Share account credentials with others
  • Use the service to spread misinformation or harmful content

5. Content and Data

5.1 User Content

  • You retain ownership of content you save through our service
  • By using our service, you grant us a license to process, store, and analyze your saved content to provide our services
  • We only access the specific posts you save or share with us, not your broader social media profile or activities

5.2 AI-Generated Content

  • Our AI may generate responses, suggestions, and actions based on your saved content
  • AI-generated content is provided for informational purposes and may not always be accurate
  • You are responsible for verifying any information before acting on it

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

7. Fees and Subscription

7.1 Current Pricing

  • Our service is currently free to use
  • We reserve the right to implement subscription fees for usage above certain limits in the future

7.2 Future Pricing Changes

  • We will provide at least 30 days' notice before implementing any subscription fees
  • Existing users will be grandfathered under current terms for a reasonable transition period

8. Data Deletion and Account Termination

  • You may delete individual saved posts or your entire account at any time
  • Upon account deletion, all associated data will be permanently removed from our systems
  • You may contact us at legal@highlight.baby to request data deletion

8.2 Service Termination

  • We may suspend or terminate accounts that violate these Terms
  • We may discontinue the service with reasonable notice to users

9. Intellectual Property

9.1 Our Rights

  • Highlight, our logo, and our proprietary technology are owned by us
  • You may not copy, modify, or distribute our intellectual property

9.2 Third-Party Content

  • Social media posts saved through our service remain the property of their original creators
  • We do not claim ownership of third-party content processed through our service

10. Disclaimers and Limitations

10.1 Service Availability

  • We provide our service "as is" without warranties
  • We do not guarantee uninterrupted service availability
  • We are not responsible for content moderation beyond what social media platforms provide

10.2 AI Limitations

  • AI-generated responses may contain errors or inaccuracies
  • We are not liable for decisions made based on AI-generated content
  • Fact-checking and content verification are provided for informational purposes only

11. Limitation of Liability

To the maximum extent permitted by law, Highlight shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our service.

12. Indemnification

You agree to indemnify and hold Highlight harmless from any claims, damages, or expenses arising from your use of our service or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts of San Francisco County, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through our service. Continued use after changes constitutes acceptance of the updated Terms.
